Many employees are supposed to receive overtime, but their employers either do not know the law or simply refuse to follow it. Studies have shown that there are millions of Americans working in jobs that should be receiving overtime, but which do not. Workers in the service, sales, construction, and hospitality industries are particularly vulnerable to this type of treatment. So, too, are employees who receive tips or commissions as part of their pay. Finally, many employees are classified as “independent contractors” but who are in fact “employees” under the law and who should be receiving proper overtime compensation. If you were supposed to be paid overtime, but were not, you can be entitled to all the money you were not paid, plus an award of damages.
